General Terms and Conditions of Speedjust

1 General points

1.1 The General Terms and Conditions (hereinafter referred to as T&Cs) regulate the contractual arrangements and services between Speedjust and its customers in their entirety. Any T&Cs of third parties do not apply.

1.2. All correspondence must be sent to the email address info@speedjust.store.

2 Offer and conclusion of contract

2.1. The offer of the online shop www.speedjust.store is aimed at adult, legally competent customers residing in Switzerland. Offers are non-binding and subject to change.

2.2. The customer receives a non-binding confirmation of receipt of the order. An order is only concluded with the shipping confirmation.

2.3. When purchasing from Speedjust, the purchase contract is concluded directly between the customer and Speedjust.

2.4. Ordering goods and/or viewing information about certain products is generally possible if the customer registers at www.speedjust.store with an individual customer account or as a guest.

3 Order and delivery

3.1. Orders are accepted via the website www.speedjust.store. If an item is not available after confirmation of receipt of the order, the corresponding order will be cancelled. The customer cannot assert any further rights against Speedjust.

3.2. The delivery time stated in the offer or in the order confirmation is only a guideline and not binding. If Speedjust cannot meet a delivery deadline, the customer can withdraw from the order 30 days after confirmation of receipt of the order by sending a written notification to info@speedjust.store.

3.3. Speedjust is entitled to make partial deliveries. If delivery of part of the ordered goods is not possible, there is no right to cancel the entire order. The customer cannot assert any further rights.

3.4. Delivery is made exclusively to addresses in Switzerland at the customer's expense and risk. Delivery is generally only made to the customer's curb/PO box.

3.5. The customer undertakes to immediately check the goods received for accuracy, completeness and integrity. Any damage to the goods received or picked up must be reported to Speedjust within 24/48 hours. If the customer notices damage upon delivery, it is IMPORTANT that the words "PACKAGE VISIBLY DAMAGED" are clearly marked on the courier's shipping note. In the event of a complaint, the customer must keep all parts of the original packaging. The customer may only delete such parts with the written consent of Speedjust.

3.6 Import duties are not included in the order. These vary depending on the price and weight of the item.

4 Prices

4.1. Speedjust reserves the right to change the price at any time. The price published at the time of the order applies. Price changes that occur after confirmation will not be taken into account.

4.2. All prices published in the online store www.speedjust.store are inclusive of value added tax (VAT) in Swiss francs. Additional costs (e.g. shipping costs, packaging, surcharges for certain payment methods) are not included in the price and are shown and charged separately. We reserve the right to make technical changes, errors and misprints.

5 Payment and retention of title

5.1. The payment methods specified on the Speedjust website are accepted. Speedjust can exclude certain payment methods generally or for individual customers without giving reasons. Speedjust is entitled to charge surcharges for the use of individual payment methods. Speedjust reserves the right to check the customer's creditworthiness and can pass on customer data to third parties for this purpose.

5.2 When purchasing by direct debit or credit card, the invoice is issued at the time of the order. The payment details of the debit or credit card are transmitted in encrypted form. When purchasing by advance payment and over CHF 200, the order is only activated after Speedjust has received payment. During this time it is not possible to reserve the desired items. If there is little availability of goods, goods with the status "in stock" may no longer be available immediately at the start of the order. Speedjust can cancel the order if payment is not received within 5 working days.

In the case of a purchase via Powerpay invoice, the following conditions apply:

Purchase by invoice with partial payment option (POWERPAY)

As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview.

When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice, you are also agreeing to our GTC, POWERPAY’s https://www.powerpay.ch/en/agb. (powerpay.ch/en/agb).

You will receive the single invoice free of charge by email. With purchase on invoice you accept the https://www.powerpay.ch/en/agb from POWERPAY (powerpay.ch/en/agb), provided you have a valid email address.

5.3. Products delivered by Speedjust remain the property of Speedjust until Speedjust has received payment of the full purchase price (including all surcharges). The customer undertakes to use the products carefully while they are the property of Speedjust.

6 Returns, warranty and repairs

6.1. Right of return and exchange

Speedjust offers a limited right of return. Please understand that we cannot accept items back in all cases. The return/refund conditions can be found on the return conditions page.

In any case, the return must be requested via info@speedjust.store, stating all details of the order.

6.2. Scope of the guarantee

Speedjust grants the customer a guarantee on the products purchased. In the event of a warranty claim (i.e. in the event of defects that occur or already exist before or after delivery of the product or goods to the customer), the customer has the right to repair, replacement or termination of the contract. The choice of the method of remedying the defect is at the discretion of Speedjust. If Speedjust decides to terminate the contract, the amount of the refund to the customer will be adjusted to the current value of the defective device. There is no entitlement to a free replacement device for the period required to remedy the defect.

The following are excluded from the guarantee:

Damage caused by natural elements;

Damage caused by moisture;

Damage caused by impacts or falls;

Wear and tear due to normal use;

Manipulation;

Damage due to the effects of external influences;

Interventions on the product or changes to the product;

Consumable parts such as batteries, rechargeable batteries, projection lamps and housing parts;

The statutory warranty is completely excluded.

6.3. Warranty period and manufacturer's guarantee

The duration of the guarantee for each item is stated on the delivery note; for new devices it is at least 2 years and begins at the time of delivery. Any repairs or replacements do not extend the guarantee period. The delivery note has the value of a guarantee certificate and must be kept carefully.

6.4. Procedure in the event of defects

In the event of defects that do not fall under the warranty exclusion reasons, the customer must contact www.speedjust.store. The right to reimbursement of the costs for repairs by third parties is excluded. The customer is obliged to deliver or send the defective product to the address specified on the delivery note at his own expense. The products must be delivered or sent with all accessories in the original packaging and with the purchase receipt/delivery note enclosed. If the original packaging is missing, the product must be packaged appropriately for transport. If the product sent in is not covered by the warranty (existence of exclusion reasons

8 Data processing and data protection

So that we can continually improve our offers within Speedjust and inform you about products and offers that are suitable for you, we evaluate the data about your purchases and your online behavior, provided you have a customer account with us, and use this data accordingly in accordance with the following principles.

By accepting these terms and conditions, you agree that your personal data such as name, address or email address together with purchase data and online behavior data will be collected and evaluated within Speedjust for marketing and advertising purposes. The data will only be used within Speedjust and will not be passed on to third parties (for advertising purposes). On the basis of this data, it is possible to form target groups consisting of customers with similar and comparable interests and purchase data. Generally accepted mathematical and statistical methods are used for this purpose. This data can be merged with other data collected about you by our company. This integration can include demographic, contact, financial, purchase, transaction, online recognition, location and traffic data or specific analyses. If you have given our company your consent in another area (e.g. by registering for a newsletter), you can receive personalized information about products or offers that are relevant to you based on the analyses. You can revoke your consent at any time with effect for the future and unsubscribe from messages received. Based on the analyses, we can also show you personalized advertising or recommendations on our website.

9 Applicable law

These general terms and conditions can be changed at any time. Swiss law applies exclusively. The competent place of jurisdiction is alternatively the customer's registered office or the registered office of Speedjust.
